1. Who we are

DiveOps (“DiveOps.ai”, “we”, “us”, “our”) is a software platform for dive centre operations. DiveOps.ai is operated by Courtney Evans Holdings Limited (Company no. 07384166), a company registered in England and Wales.

2. Agreement

By creating an account or using DiveOps, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

These Terms form a legally binding agreement between you (either personally or as an authorised representative of a dive centre) and Courtney Evans Holdings Limited, the company that operates DiveOps.ai.

3. The service

DiveOps provides a web-based platform and associated WhatsApp Business integration for managing dive centre operations. Features include but are not limited to customer records, bookings, staff management, gear tracking, boat management, compliance alerts, and AI-assisted customer messaging.

We may add, change, or remove features at any time. We will give reasonable notice of material changes.

4. Accounts

To use DiveOps, you must create an account. You agree to:

  • Provide accurate, current information during registration
  • Keep your login credentials secure
  • Notify us immediately of any unauthorised use
  • Be responsible for all activity under your account

You must be at least 18 years old to create an account. Accounts are for business use only.

5. Your data and customer data

You retain all rights to the data you upload or generate in DiveOps, including data about your own customers.

When you use DiveOps to process personal data about your customers (for example, booking records or WhatsApp messages), you act as the data controller and DiveOps acts as the data processor. Our obligations as processor are set out in our Privacy Policy and the Data Processing Addendum (available on request).

You warrant that you have the legal right to upload any personal data to DiveOps and to use WhatsApp Business messaging with your customers in accordance with Meta's WhatsApp Business Messaging Policy.

6. Acceptable use

You must not use DiveOps to:

  • Send spam, unsolicited messages, or content that violates WhatsApp Business policies
  • Process personal data unlawfully or without the subject's consent where required
  • Reverse engineer, decompile, or attempt to extract source code
  • Interfere with, disrupt, or attempt to gain unauthorised access to any part of the service
  • Resell, sublicense, or white-label DiveOps without written permission
  • Use the service in any way that breaches applicable law

Violation may result in suspension or termination of your account.

7. Fees and billing

Paid plans are billed monthly or annually in advance, as selected at sign-up. All fees are stated in GBP unless otherwise specified and are exclusive of applicable taxes.

Payment is due on the date stated on your invoice. Late payment may result in suspension of service. We may change our pricing with at least 30 days' notice for existing subscriptions.

Refunds are not provided for partial billing periods except where required by law.

8. Third-party services

DiveOps integrates with third-party services, including Meta (WhatsApp Business Platform), Anthropic (AI), and others. Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or reliability of third-party services.

9. Intellectual property

The DiveOps platform, including all software, designs, logos, and documentation, is owned by DiveOps.ai and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to use DiveOps in accordance with these Terms.

You may not copy, modify, distribute, or create derivative works based on DiveOps without our written permission.

10. Warranties and disclaimers

DiveOps is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, or secure against all threats.

We make no warranties beyond those required by applicable law. Implied warranties of merchantability, fitness for a particular purpose, and non-infringement are excluded to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to DiveOps is limited to the fees you paid us in the 12 months preceding the claim.

We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, lost data, or business interruption.

Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.

12. Termination

You may cancel your account at any time from your account settings. Cancellation is effective at the end of your current billing period.

We may suspend or terminate your account if you breach these Terms, fail to pay, or if required by law. We will give reasonable notice where possible.

On termination, your access to the service ends. We will delete your data in accordance with our Privacy Policy and data retention periods.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to account holders at least 30 days before they take effect. Continued use of DiveOps after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
